Terms & Conditions

This Website Design Contract (“Contract”) is between Benjamin Vicente, trading as Benza Web (“Designer”) and the client (“Client”). By paying the deposit or otherwise engaging Benza Web for services, the Client accepts all terms below.

1. Project Overview

Designer will create a custom website for the Client based on the details discussed during the discovery call, messages, or written brief. Final deliverables, pricing, and timelines will be confirmed in the project proposal.

2. Scope of Work

The project includes: website design and build using WordPress and Elementor, a fully mobile responsive layout, basic SEO setup (titles, descriptions, headings), contact form setup, integration of Client-provided content (text, images, branding), and launch and handover. Not included unless stated in the proposal: logo design, copywriting, advanced SEO, custom development, e-commerce setup, ongoing maintenance, hosting or domain purchase, and third-party subscriptions or plugins. Any work outside the agreed scope will require a separate quote.

3. Timeline

Designer will provide an estimated timeline. Timelines may change if the Client delays sending content, requests additional features, or requests revisions beyond the agreed limit. Designer is not responsible for delays caused by the Client.

4. Payments

A 50% non-refundable deposit is required before work begins. The remaining 50% is due before launch or handover of the website. Payments are made via Stripe Payment Links, unless otherwise agreed. Designer may pause work if payments are not made on time.

5. Revisions

The project includes up to 2 rounds of revisions per page. Additional revisions or new feature requests may incur extra charges.

6. Client Responsibilities

The Client agrees to provide all required content (text, images, branding), provide accurate business information, approve designs and respond in a timely manner, and ensure they own the rights to any content provided. Designer is not responsible for copyright issues caused by Client-provided content.

7. Launch & Handover

The website will be launched once final payment is received and the Client approves the final version. After launch, Designer will provide admin login details, basic instructions for editing content, and optional maintenance plan information.

8. Ownership

Once final payment is made, the Client owns the website design and all content they provided. Designer retains ownership of any custom templates or tools unless otherwise agreed. Designer may showcase the project in their portfolio unless the Client requests otherwise.

9. Hosting & Domain

The Client may choose to own and manage their own hosting and domain, or have Benza Web manage hosting and domain on their behalf as an additional paid monthly service. If Benza Web manages hosting and domain, these remain active only while payments are up to date, and ownership of the hosting account and domain remains with the Designer until all fees are fully paid; if payments stop, the website may be suspended until the balance is cleared. If the Client prefers to own their hosting and domain, Designer will assist with setup and migration at no extra cost unless stated otherwise, and the Client is responsible for renewing their hosting and domain to keep the website online.

10. Maintenance & Support

Ongoing maintenance is not included unless the Client purchases a maintenance plan. Maintenance plans may include website updates, backups, security monitoring, uptime monitoring, small content changes, and priority support. If the Client does not purchase a maintenance plan, the Client is responsible for keeping their website updated and secure, and Designer is not liable for issues caused by outdated software, plugins, or hosting.

11. Cancellation

If the Client cancels the project, the deposit is non-refundable, any completed work must be paid for, and Designer may provide partial files at their discretion. If the Designer cancels the project, the Client will receive a refund for any incomplete work.

12. Liability

Designer is not liable for loss of revenue, hosting issues, third-party service failures, security breaches caused by weak Client passwords, or content provided by the Client. Designer’s total liability is limited to the amount paid by the Client.

13. Contract Acceptance

By paying the deposit or otherwise engaging Benza Web for services, the Client confirms they understand and accept all terms listed above.
